Terms and Conditions

1. About the Service
BetterCallSam is an AI-powered tax submission service that helps UK sole traders file quarterly updates and final declarations to HMRC under Making Tax Digital for Income Tax Self Assessment (MTD ITSA). By using this service, you agree to these terms and conditions.
2. Eligibility
This service is designed for UK self-employed sole traders with a single self-employment business who are not registered for VAT. You must be enrolled in Making Tax Digital for Income Tax Self Assessment (MTD ITSA) and have a valid Government Gateway account. You must be at least 18 years old to use this service.
BetterCallSam does not support property income, partnerships, limited companies, VAT returns, or multiple self-employment businesses. If you use the service for income types outside this scope, the accuracy of submissions cannot be guaranteed and any resulting issues with HMRC are your responsibility.
3. Your Responsibilities
- Accuracy of data — you are responsible for ensuring the financial data you upload is accurate and complete. You must review all categorisations and summaries before confirming submission to HMRC.
- Tax obligations — you remain solely responsible for meeting your tax obligations and filing deadlines. BetterCallSam is a tool to assist you, not a substitute for professional tax advice.
- HMRC credentials — you are responsible for keeping your Government Gateway credentials secure. You authorise BetterCallSam to access HMRC APIs on your behalf via OAuth 2.0 when you complete the authentication flow.
- Lawful use — you must not use this service for fraudulent purposes or to submit deliberately inaccurate information to HMRC.
4. AI-Assisted Processing
BetterCallSam uses artificial intelligence (powered by Anthropic's Claude) to categorise your financial transactions into HMRC-compliant categories. While we strive for accuracy:
- AI categorisations are suggestions and must be reviewed by you before submission
- The AI assistant provides general guidance, not professional tax advice
- You are responsible for verifying all data before confirming submission to HMRC
5. HMRC Submissions
When you confirm a submission, BetterCallSam sends your data directly to HMRC via their official MTD APIs. Once submitted, changes may not be reversible without contacting HMRC directly. You must review all summaries on the review screen before confirming. By clicking confirm, you authorise us to submit the displayed data to HMRC on your behalf.
6. Service Availability
We aim to keep BetterCallSam available at all times but do not guarantee uninterrupted access. The service depends on HMRC API availability, which is outside our control. We are not liable for any losses arising from service downtime or HMRC API outages. We recommend not leaving submissions to the last day before a deadline.
7. Limitation of Liability
To the fullest extent permitted by law:
- BetterCallSam is provided “as is” without warranty of any kind
- We are not liable for any penalties, fines, or interest charged by HMRC as a result of incorrect or late submissions
- We are not liable for any indirect, consequential, or incidental damages arising from your use of the service
- Our total liability to you shall not exceed the amount you paid for the service in the 12 months preceding the claim
8. Data and Privacy
Your use of BetterCallSam is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using this service, you consent to the data practices described in that policy.
9. Intellectual Property
All content, features, and functionality of BetterCallSam (excluding your personal data and uploaded files) are owned by BetterCallSam and are protected by copyright and other intellectual property laws. Your financial data remains yours at all times.
10. Termination
You may stop using BetterCallSam at any time. We may suspend or terminate your access if you breach these terms or use the service in a way that could harm other users or HMRC systems. Session data is not retained after your session ends.
11. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes. Continued use of the service after changes constitutes acceptance of the updated terms.
12. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
